Terms of Use

1. About the service

heti.io (the “service”, “we”) is a service that sends alerts about rental offers published in Telegram and Facebook communities across South Florida. By using the service you agree to these terms. If you do not agree with them, do not use the service.

What we are not. We are not realtors, brokers, agents or a management company. We are not a party to any lease and we take no part in negotiations, viewings, tenant screening, or the handling of payments and deposits. Any deal is made directly between you and the author of the listing.

2. Where the listings come from

We do not create the listings. They are messages that their authors published in Telegram and Facebook communities. We do not collect them ourselves: the data reaches us from third-party data providers whose operation and access we do not control.

We do not edit the content of listings and we do not present it as our own. Every alert names the source and includes a link to the original or to the author. The rights to the text and photos in listings belong to their authors; we claim no rights to them.

3. No warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied. In particular, we do not warrant that:

• the information in a listing is accurate, current and complete;
• the property exists, is available, and is offered on the stated terms;
• the author of the listing is the actual owner or an authorised person;
• you will receive every suitable listing: a source can close, a data provider can fail, a listing can go unrecognised;
• an alert will arrive within any particular time, or that the service will run without interruptions and errors;
• you will find housing.

We do not verify listings, we do not verify landlords and we do not screen for fraud.

4. Your safety

There are scammers among rental listings. Reasonable precautions are on your side: view the property in person or through someone you trust, do not transfer money, a deposit or prepayment before you have seen it and signed a lease, do not send scans of your documents to strangers, and check who owns the property.

We are not liable for the actions of listing authors or any third parties, including fraud, inaccurate listings and deals that fall through.

5. Limitation of liability

To the maximum extent permitted by law, we are not liable for damages, lost profit or any indirect losses connected with the use of the service. That includes an apartment you did not get, whatever the reason: a delayed alert, a missed listing, an interruption in the service, a filtering error or a failure of a third-party data provider.

The total liability of the service to you across all claims is limited to the amount you actually paid us over the last 30 days.

6. Payment and refunds

Paid passes are one-off payments for a period of monitoring. There is no subscription and no automatic renewal: when the period ends, nothing is charged. Payments are processed by Stripe; we neither receive nor store your card details.

You are paying for time on fast monitoring, not for a result. Refunds are not issued, including for an absence of suitable listings, for paid time you did not use, for a change of plans, or for housing found another way. Mistaken or duplicate charges we do look into and fix.

7. Rules of use

By using the service you agree that:

• you are 18 or older;
• you use the service to search for housing for yourself, not to resell it;
• you will not mass-forward, publish or resell the alerts you receive, and will not build your own service on them;
• you will not scrape the service’s data automatically, interfere with its operation or work around its limits;
• you will not use the service for spam, mailing lists or anything that breaks the rules of Telegram, Facebook or the law.

8. Fair housing

We support the principles of the Fair Housing Act and of Florida fair housing law. The service takes no part in selecting tenants and does not allow listings to be filtered by race, colour, religion, sex, national origin, familial status or disability. Search criteria cover only the characteristics of the housing: area, budget, type, number of bedrooms, term, furniture, pets.

The word “Russian-speaking” in the description of the service refers to the language of the communities the listings come from. It is not a characteristic of the people to whom housing is or is not rented.

9. Rights to the service’s content

The name, the logo, the design of the site and the software behind the service belong to us. The content of listings belongs to their authors and to the platforms where they were published.

If you believe an alert infringes your rights, write to us through the @heti_io_bot bot with the link and the substance of the claim. We will review it and may, at our discretion, stop showing the material in question. This does not create an obligation for us to remove material on any demand.

10. Changes and termination

We may change what the service includes, the set of sources, the prices and these terms. The current version is always published on this page, and the date of the last update is shown at the top. We may limit or end access to the service if it is used in breach of these terms.

11. Governing law

These terms are governed by the law of the State of Florida, USA, without regard to its conflict of laws rules. Disputes are heard in the courts of the State of Florida.
